AceGiftedTest is a product and service provided by Lumina Ed LLC.

By accessing or using the Service, creating an account, or clicking "I Agree," you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Eligibility

The Service is intended for individuals 18 years or older. Students under 18 may use the Service only with the supervision and consent of a parent, guardian, or teacher. The supervising adult is responsible for the student’s use of the Service and compliance with these Terms.

2. Description of Service

AceGiftedTest provides online practice materials and learning tools designed to help students develop reasoning and academic skills commonly evaluated in cognitive ability and gifted program entrance assessments. The Service may be updated, modified, suspended, or discontinued at any time.

3. Accounts

To access certain features, you may be required to create an account. You agree to provide accurate registration information, maintain the confidentiality of your login credentials, and notify us of unauthorized access. You are responsible for all activity occurring under your account. Accounts may not be shared across multiple families.

4. Subscription and Payments

Some features require payment. Fees and billing periods are disclosed at the time of purchase. Unless otherwise stated, all purchases are final and refunds are not guaranteed except where required by law. Users are responsible for applicable taxes.

5. Automatic Renewal Disclosure (California)

Certain subscriptions may automatically renew. If automatic renewal applies, the subscription will renew automatically at the end of each billing period unless canceled, the renewal fee will be charged to your payment method on file, and renewal terms and pricing will be clearly disclosed at purchase. You may cancel automatic renewal at any time through your account settings or by contacting support. Cancellation will take effect at the end of the current billing cycle. This disclosure is provided in compliance with California Business & Professions Code §17600 (Automatic Renewal Law).

6. Acceptable Use

You agree not to misuse the Service, interfere with system security, upload malicious software, scrape or automate data extraction, or attempt unauthorized access. Violation may result in suspension or termination of access.

7. Intellectual Property

All Service materials—including software, practice questions, graphics, videos, and written content— are owned by Lumina Ed LLC or its licensors and protected by intellectual property laws. You may not reproduce or distribute content, reverse engineer software, create derivative works, or commercially exploit the Service.

8. Independent Educational Content

All practice questions and instructional materials are independently authored educational content created for instructional purposes. AceGiftedTest does not obtain, use, reproduce, or rely upon confidential or proprietary examination materials belonging to any test publisher. Contributors to AceGiftedTest represent that they are not violating confidentiality obligations to any testing organization.

9. Fair Use Notice

Practice questions provided by AceGiftedTest are original content developed independently and are not official test questions. Any resemblance to actual test items is coincidental. We do not reproduce proprietary test materials.

10. Skills-Based Practice Disclaimer

AceGiftedTest materials are designed to help students develop reasoning skills and familiarity with assessment formats. These materials do not replicate secure examination questions and should not be interpreted as representations of actual test items.

11. Trademark Disclaimer

AceGiftedTest is an independent test preparation service. We are not affiliated with, endorsed by, sponsored by, or approved by Riverside Insights®, CogAT®, or any official gifted assessment publisher. All referenced trademarks are the property of their respective owners and are used solely for descriptive purposes.

12. Limited Trademark Reference

References to third-party exams or organizations are made solely to describe the educational services offered and the assessments for which students may prepare. Such references do not imply sponsorship, endorsement, or affiliation.

13. No Guarantee of Results

AceGiftedTest provides educational practice tools. We do not guarantee improved test scores, acceptance into gifted programs, or admission into any school. Testing outcomes are determined solely by the organizations administering the relevant assessments.

14. Data Retention

We retain account and performance data only as long as reasonably necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Upon written request, users may request deletion of personal information, subject to legal retention requirements. We are not responsible for a user’s failure to download content prior to subscription expiration.

15. Third-Party Services

The Service may contain links to third-party websites or tools. We are not responsible for the content or policies of third-party services.

16. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Lumina Ed LLC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, Lumina Ed LLC shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid by the user in the twelve (12) months preceding the claim.

18. Indemnification

You agree to indemnify and hold harmless Lumina Ed LLC and its affiliates from claims arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

19. Copyright Complaints (DMCA)

AceGiftedTest respects intellectual property rights. If you believe material on the Service infringes copyright, you may submit a DMCA notice including identification of the copyrighted work, location of the allegedly infringing material, contact information, a statement of good faith belief, and a statement made under penalty of perjury. 20. Dispute Resolution and Arbitration

Except for small claims matters or requests for injunctive relief, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Santa Clara County, California, the user’s county of residence, or via video conference.

Before arbitration, the parties agree to attempt informal resolution for 30 days after written notice of the dispute.

Disputes must be brought individually. Class actions and representative proceedings are waived. Users may opt out of arbitration within 30 days of first accepting these Terms by emailing support@acegiftedtest.com.

21. Force Majeure

Lumina Ed LLC is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, government actions, or cyberattacks.

22. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

23. Changes to Terms

We may update these Terms periodically. Continued use of the Service after updates constitutes acceptance.
